General Terms and Conditions Agreement
Introduction
Welcome to Aqualite Center. By using our services or purchasing products through our website or in person, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.
These Terms, together with the Service Purchase Agreement, the Refund & Exchange Policy, and the Privacy Policy, form the legal framework governing your relationship with Aqualite. If you do not agree to any part of these Terms, you should refrain from using our services or completing any purchase.
- General Terms
1.1 Eligibility
To use our services, you must be at least 18 years old, or have written consent from a parent or legal guardian. By using our services, you confirm that you meet this requirement.
1.2 Amendments to the Terms
Aqualite Center reserves the right to update or amend these Terms at any time. Any changes will be published on our website or communicated through our official channels. Continued use of our services after such publication constitutes your acceptance of the amended Terms.
1.3 Compliance with Laws
All clients and visitors are required to comply with all applicable laws and regulations in the Kingdom of Saudi Arabia, including those issued by the Ministry of Health, Ministry of Commerce, the Saudi Food and Drug Authority (SFDA), and other relevant regulatory authorities. Aqualite Center bears no responsibility for any legal violations committed by the client.
1.4 Integration of Agreements
These Terms are an integral part of the Service Purchase Agreement, the Refund & Exchange Policy, and any forms or declarations signed at the time of subscription or during service delivery.
- Services and Products
2.1 Services Provided
Aqualite Center provides:
- Clinical nutrition and nutrition counseling,
- Aquatic exercise and water-based programs,
- Non-invasive body shaping / firming / contouring device sessions,
- Physical activity, functional training and movement supervision,
and other related wellness and supportive health services.
All services are provided as supportive wellness / health-improvement services. They are not a substitute for medical treatment or medical diagnosis, and are not presented as a treatment or cure for diseases, nor as a replacement for clinical management prescribed by medical professionals.
2.2 Product Purchases
Products may include dietary supplements, health products, beverages, healthy snacks, equipment and health/fitness accessories. All product sales are subject to actual availability. Aqualite reserves the right to refuse or cancel any order in case of unavailability, pricing errors, or system issues.
2.3 Pricing and Payment
All prices are in Saudi Riyals (SAR). They may include or exclude VAT as indicated on the invoice. Payments must be made using approved methods at the time of purchase. Aqualite reserves the right to adjust prices at any time without prior notice. Price changes do not affect orders that have already been fully paid.
2.4 No Guarantee of Results
Outcomes from programs (such as weight loss, body firming, circumference reduction, or fitness improvements) vary from person to person, depending on health status, adherence, and individual factors. Aqualite does not provide any express or implied guarantee of achieving specific results within a defined timeframe.
- Booking and Appointments
3.1 Booking Services
Appointments must be booked in advance via phone, website, app, or in person. Booking at least 24 hours in advance is recommended to secure availability.
3.2 Cancellation or Rescheduling
Cancellations or rescheduling must comply with the Attendance & Cancellation Policy within the specified time window. Failure to do so may result in session deduction or administrative fees, as defined in the Service Purchase Agreement and Attendance & Cancellation Policy.
3.3 No-Show Policy
If the client does not attend the booked appointment without proper notice in accordance with policy, Aqualite has the right to deduct the session or charge the relevant fee. This is part of managing operational capacity and protecting the rights of other clients.
- Refund and Exchange Policy
4.1 Products – Refunds and Exchanges
Product refunds and exchanges are governed by the approved Refund & Exchange Policy. Products are eligible only if in their original condition, unopened, unused, and within the allowed time frame.
4.2 Services – Refunds
Payments for sessions, programs, and memberships are subject to the Refund & Exchange Policy and the Service Purchase Agreement. Amounts paid for services that have already been delivered (completed sessions) are not refundable. Approved refunds, when applicable, are calculated only on the unused portion and in accordance with the relevant policy.
4.3 Expiry of Services
Any program, package, or session balance not used within the specified validity period will be void and non-refundable. Extensions, if offered, are subject to policy, conditions, and any applicable fees.
- Liability, Warnings and Disclaimers
5.1 Client’s Health Responsibility
By using our services, you acknowledge and accept full responsibility for your health status and confirm that you have consulted a qualified physician when necessary before starting any nutrition program, physical activity, or device session. You also agree to inform our specialists of any medical conditions, medications, allergies, or relevant medical history that may affect the suitability or safety of the service.
5.2 Inherent Risks of Activities
You understand that physical activities and use of devices inherently carry certain risks (e.g., muscle soreness, fatigue, dizziness, changes in blood pressure, etc.). Participation is voluntary and at your own responsibility, and you commit to following all instructions and safety guidance provided by the specialists.
5.3 Children and Older Adults
For children, older adults, and individuals with special medical needs, a parent, guardian, or responsible companion must ensure that the client is medically suitable before using any service.
The parent/guardian/companion is responsible for accompanying and supervising them during use of services/devices and for ensuring adherence to safety instructions. Aqualite is not liable for any harm resulting from lack of supervision or failure to disclose important medical information.
5.4 Instructions and Supervision
Clear instructions are provided by qualified specialists and trainers. Aqualite is not liable for any damage resulting from ignoring or failing to follow these instructions or from insisting on continuing an activity after being advised to stop.
5.5 Limitation of Liability
Aqualite Center’s liability, in all cases, is limited to the value of the service or product that is the subject of the claim, and only to the extent permitted by applicable law.
Aqualite is not liable for:
- indirect, consequential, or moral damages;
- loss of profit, loss of opportunity, or any loss arising from misuse of services or violation of instructions and policies.
In the event of a defect attributable to Aqualite in a device or service, the Center will act to correct the situation as soon as reasonably possible, without assuming any further liability.
5.6 No Medical Advice
Information provided in sessions, printed materials, digital content, or social media is for general wellness awareness only and does not constitute medical diagnosis, medical treatment, or a prescription. It does not replace consultation with a licensed physician.
5.7 Medical Reports
If a request for refund, freezing, or termination of a program is based on medical grounds, the medical report must:
- be issued by a recognized medical entity;
- clearly state the inability to continue with the specific type of service;
- be dated consistently with the subscription period or incident in question;
- be properly signed and stamped.
Aqualite reserves the right to verify the authenticity and adequacy of any report before taking action.
5.8 Emergency Situations
In case of an emergency within the Center, staff will follow internal procedures (such as stopping the session, providing basic first aid, and calling emergency services). This does not constitute an obligation to provide specialized medical care; it is an initial response until the case is handed over to the competent medical authorities.
5.9 Protection of Staff and Management from Abuse
The following are strictly prohibited:
- Any verbal or physical abuse, insult, threat, or degrading language towards any employee, specialist, or manager.
- Any attempt to pressure or blackmail the Center (including threats of defamation or negative reviews) to obtain non-entitled exceptions such as unjustified refunds.
In such cases, the Center reserves the right to:
- immediately suspend or terminate services or membership without refund;
- restrict future access to the Center;
- pursue legal action and lodge complaints with competent authorities as permitted by law.
5.10 Prohibition of Defamation and Reputation Harm
The client agrees not to publish or circulate false, misleading, or malicious statements about the Center or its staff, and not to film or record sessions or staff without prior written consent.
If the client has any complaint or concern, it must be submitted via the official channels (email, phone, official forms) so it can be handled under the approved procedures.
Aqualite reserves the right to seek compensation and initiate legal proceedings, where necessary, for any intentional defamation or reputational harm affecting the Center or its staff.
- Privacy and Data Protection
6.1 Privacy Policy
Aqualite is committed to protecting your personal data in accordance with its Privacy Policy. Personal data will not be shared except in cases allowed by law, with your consent, or upon request from competent regulatory or judicial authorities.
6.2 Use of Data
By using our services, you consent to the collection, processing, and use of your data to the extent necessary to provide services, enhance customer experience, and comply with legal obligations, while maintaining confidentiality according to applicable regulations.
- Intellectual Property Rights
7.1 Copyright
All content on Aqualite’s website and platforms—including text, images, graphics, logos, designs, icons, and software—is the property of Aqualite Center and is protected by copyright laws. You may not copy, reproduce, modify, or distribute any content without prior written consent.
7.2 Trademarks
The Aqualite name, logo, and any related marks are trademarks owned by Aqualite Center. Any use of these trademarks without written permission is strictly prohibited.
- Force Majeure
Aqualite shall not be liable for any delay or failure in performance arising from circumstances beyond its reasonable control, including but not limited to natural disasters, public utility failures, strikes, governmental decisions, public health emergencies, or road closures. In such events, the Center will make reasonable efforts to reschedule services but shall have no further liability.
- Dispute Resolution
9.1 Governing Law
These Terms and any dispute arising out of or relating to them are governed by the laws and regulations of the Kingdom of Saudi Arabia.
9.2 Amicable Resolution First
In the event of a dispute, both parties agree to attempt to resolve the matter amicably through the Center’s official communication channels.
9.3 Referral to Competent Authorities / Arbitration
If an amicable solution cannot be reached, the dispute shall be referred—depending on its nature—to the competent judicial or arbitration authority in the Kingdom of Saudi Arabia, in accordance with applicable laws and regulations.
